General Condition:

Poor. Vinegar smell. The document is badly creased and torn into separate pieces at points. Appears slightly yellowed and weakened by age. There are a few spots on the document that were either seals changing over time or stains. Handle with care.

Description:

The following item dated August 15, 18[06], depicts a deed from Gideon Granger to Jacob Cist and Horace Hampden Edwards. The deed is for multiple tracts located in Jefferson township, Geauga county, Ohio, with lot 7 containing 2 acres with an addition of two lots in the town plot containing 8 acres each, lots 179, 180, and an 80 acre draft lot named lot 36, containing 77 acres and 53 hundreths of an acre. Edwards and Cist pay Granger $200.00 for the contract, and a final note makes a stipulation of a $12.00 lean on the lands held by Granger for the possibility of the lands becoming a seat of Justice for the county. Those dues are being withheld in case they need to build a public building. In the third section of the deed, Granger transfers over all rights and profit to the tracts of land from himself and his heirs to Cist and Edwards, with their respective heirs. The deed is witnessed by William Gardner, Seth Parsons, David Shoemaker, and Benjamin Granger. There is a signature by Mindwell Granger, wife of Gideon, who on the reverse of the manuscript is counseled outside of her husband to confirm that she is releasing and selling the lands of her own free will, without fear of her husband’s displeasure. That testimony is signed by Asahel Hathaway, and dated December 3, 1806. The reverse also has testimony from William Thorton, town magistrate, stating that Granger confirmed the sale as his own free will, dated November 12, 1806. The record was taken by James A Harper and logged in the record’s office on January 9, 1808. The date of the deed is covered by the affixed seal, but it is inferred as 1806 due to the testimony by Gideon and Mindwell on the reverse, both sworn after its drafting in 1806.

KNOW ALL MEN, by these presents, that I, GIDEON GRANGER, now resident in the City of Washington, for the consideration of Two hundred dollars ~~~ received to my full satisfaction of Horace Hampden Edwards & Jacob Cist both of Washington City in the county of Washington ~~ and District of Columbia the receipt whereof I do hereby acknowledge … and convey unto the said Horace Hampton Edward, and Jacob Cist all the following tracts or parcels of land, that is to say: lot number seven in Erie Street in the Township of Jefferson containing two acres, also in the Eight acre draft lying round said town plat two lots of eight acres each, being lots number one hundred and seventy nine and one hundred and eighty, also in the Eighty acre draft so called, lot number Thirty six, containing seventy seven acres, and fifty three hundredths of an acre all lying and being in the Township of Jefferson in the County of Geauga and in the State of Ohio, and reference is had to a chart of said Township now engraving (sic) by Jacob Cist for the particular Location and Boundary of each lot.

TO HAVE AND TO HOLD the above described tract … to them the said Horace Hampden Edward and Jacob Cist their heirs and assigns and to them and their sole use, benefit … I the said GIDEON GRANGER do covenant … with the said Edward & Cist their heirs and assigns … that the same are free and clear from all incumbrances … furthermore, I do for myself … covenant to and with the said Edwards & Cist their heirs and assigns …

And for the better and effectually securing the said Edward & Cist their heirs or assigns… I do covenant to and with the said Edwards and Cist their heirs and assigns, that I will, … in writing, at the proper cost, charge and expense of the said Edward & Cist their heirs or assigns, such other deeds … in writing … nevertheless the grantor has a lien on the land herein granted for the payment of twelve dollars by the grantee on his Representatives in case that a seat of Justice shall be established in said town, said seem to be applied towards the Erection of public buildings IN WITNESS WHEREOF, I have hereunto subscribed my name and affixed my seal, this fifteenth day of August in the year … one thousand eight hundred and [six] Gid[eo]n Granger Witness the Signature of Mindwell Granger Signed, sealed and delivered } Seth Parsons in presence of us Benjamin Granger W[illia]m Gardner Mindwell Granger David Shoemaker

{Back} District of Columbia Ss [sheriff station]. County & City of Washington Novemb[e]r 12th 1806. Before the subsider One of the Magistrates for the said city and county on this day came Gideon Granger who executed the within Instrument, and acknowledged the same to be his free act and deed, and that he executed the same for the uses and purpose therein mentioned. William Thornton State of Connecticut Suffield Township Hartford County Ss.[sheriff station] This 3rd day of Dec[embe]r 1806 personally came before me the subscriber Justice of the peace for –(?) Hartford County Mindwell, wife of Gideon Granger, party to the within deed and being by me examined privately, and out of the hearing of her husband she acknowledged that she surrendered & released all right little and claim of dower in the lots or parcels of ground in the within deed granted bargained & sold to the said Jacob Cist & Horace H Edward their heirs and assigns forever & also acknowledged the same willingly and freely, and without being induced thereto by fear or threat of, or ill usage by her husband or fear of his displeasure.
