Description:
The following item dated September 19, 1949, depicts two photostat copies of a land deed between Lehigh Valley Coal Company and M. J. Rafferty. This deed is built from an original warrant, dated July 28, 1949, granting two acres of surface rights in Laflin, PA. However, the deed mentions that those two acres appear to have been sold previously to Anna Monahan and so the Lehigh Valley Coal Company is offering sale a neighboring 11 acres of surface area that abuts the same acreage for $1,000. The deed covers the legalities of the rights and profits transferred from one party to the other, and states that the sale and title is safeguarded against any other claims. There is a description of the boundaries for these 11 acres following with field notes taken during the survey, some of which name other companies’ tracts or lands in the area, such as the Pennsylvania Coal Company’s along the northerly line.
The document is incomplete, as the numbered pages skips from 231 to 233, and we have no designation of the first part of the deed amendments on the second page, second-fourth. These amendments state that the coal beneath the surface of these lands will be mined progressively, potentially endangering the structure and quality of the soil, with which knowledge, the third amendment addresses that this knowledge has altered the contract regarding price proportionally, but in the fourth noting that the contract was sought by the second party, M. J. Rafferty. These appear to be protections for the mining company in case of future accidencts or damage to the acreage being sold. The deed is signed by the vice president, B. Henderson(?), the secretary of the Lehigh Valley Coal Company, James More, and Michael Joseph Rafferty.
