Description:

The following items depict a typescript of a land deed for a property in Pittston. The deed contains a survey of the land, and the release of ownership from the sale. The deed is between Samuel and Julia Ann Saylor to D. Lewis Jr. and John M. Odenheimer. The original date of the sale was July 14, 1855. In the deed sale, the lands within were sold for $30.136.87 ½ cents, and containing 100 acres and 73 perches in Plains township, once called Pittston. Following the introductory paragraph of the deed contract, there are a number of survey directions detailing the boundaries of the lands, who they abut, and in cases with the coal companies, who they were once owned by. In the final paragraph, there is a note of inheritance for the Saylor parties. The land was originally a trust that was given to Jacob Shoemaker and Frederick Saler, then handed down to Peter and Margaretta Sayler, which was to be divided among their heirs after their passing, as patented in May 1808, and was recorded in the Deed books, particularly Deed Book 63, on August 3, 1853. The sum is not listed but allows for a strip of land 20 feet wide toward the boundary of the late Samuel Willcox. There are a number of determined rights and practices that are covered under this contract, including the building and maintenance of fences on either side of the rail, improvements on the rail, and digging measures, etc. The fences are to be built by Maxwell and the interest of the rail to protect the livestock of the properties bounding it, as the contract states that the men should be compensated for any losses they suffer if the fences are not built. It is signed and sworn before Thomas Dyer, a justice of the peace.
