Title:

Court Rules In Coal Case

Description:

The following item depicts a newspaper clipping of an article entitled “Court Rules in Coal Case.” A judge from Somerset county, Norman T. Boose, ruled on Weaver vs Juliette Coal Company, a case brought forth by Mr. and Mrs. Milton Weaver in question of the company’s rights to strip mine coal from their farm. The company brought forth a 1909 agreement allowing for deep-mine coal extraction on lands, however in the artcile, Boose ruled in favor of the Weavers, upholding their rights of denial, stating that it does not grant the rights for coal stripping operations on the same lands. That would require a specific deed between the two parties, as the 1909 agreement was based on the usual mining practices of the time, and could not cognize of strip mining as it was unheard of in the area. The final ruling granted $40 per acre damaged to the Weavers, but only for that caused by deep mine operations.
