Description:

The following item depicts a deed sale on April 17, 1841, between John Lord Butler, with his wife, Cornelia R. Butler, and John Dorrance. The Butlers are selling a tract of land comprising one half of an acre plus ⅔ fourths square rods or 22,450 square feet in Wilkes Barre to Dorrance for the sum of $900.00 paid in full. There is an inclusion at the bottom of the page by John Nesbitt Conyngham, a prothonotary of the Luzerne County Sheriff Station, where he acknowledges that Butler came before him on the same day to testify that it was his free act along with that of his wife, Cornelia. Conyngham makes a mention that Cornelia was counseled apart from her husband to ensure that her part in the sale was understood in full. The back notes that the contract was recorded and placed in the Deed books office on June 23, 1841. There was a $1.87 tax for recording the sale.

This Indenture MADE THE Seventeenth day of April in the year of our Lord one thousand eight hundred and forty one Between John L. Butler of the Borough of Wilkes Barre in the County of Luzerne + State of Pennsylvania and Cornelia R. his wife of the first part, and John Dorrance of the same place of the second part, Witnesseth, That the said John L. Butler and Cornelia R. his wife for and in consideration of the sum of Nine Hundred Dollars - - lawful money of the United States of America, unto them well and truly paid by the said John Dorrance - - - at or before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged, have granted, bargained, sold, aligned, enfeoffed, released, conveyed and confirmed, and by these presents do grant, bargain, sell, alien, enfeoff, release, convey and confirm unto the said John Dorrance his heirs and assigns all that the following piece or parcel of Land on Franklin Street in the Borough of Wilkes Barre aforesaid bounded and described as follows viz. Beginning at a corner on Franklin Street Fifty feet distant from the line between lots Nos 2 & 3 in the town plot of the Borough of Wilkes Barre thence North Fifty five degrees twenty minutes East along said Street one hundred feet to a corner, thence North Thirty four degrees Forty minutes West Two Hundred twenty four feet + five tenths to a corner, thence South Fifty five degrees twenty minutes West One Hundred feet to a corner and thence South thirty four degrees forty minutes East Two HUndred Twenty four feet and five tenths to the place of beginning Containing one half of an acre + two + three fourths square rods or Twenty two thousand four hundred + fifty square feet of land, Being part of a larger pact granted by the Commth. of Pennsylvania to Lord Butler by Patent dated the Eight day of February A.D. 1805 which part on the partition of the Estate of said Lord Butler decd. became vested in the said John L Butler

Together with all and singular the improvements, ways, waters, water courses, rights, liberties, privileges, hereditaments and appurtenances whatsoever thereunto belonging or in anywise appertaining, and the reversions and remainders, rents, issues and profits thereof; and all the estate, right, title, interest, property, claim, and demand whatsoever of them the said John L Butler + Cornelia R. his wife - - in law, equity, or otherwise howsoever, of, in, and to the same and every part and parcel thereof, to have and to hold the said piece or parcel of land - - hereditaments and premises hereby granted, or mentioned and intended so to be, with the appurtenances, unto the said John Dorrance his - - heirs and assigns, to and for the only proper use and behoof of the said John Dorrance his - - heirs and assigns forever.

And the said John L Butler for himself his - - - heirs, executors and administrators, Doth by these presents, covenant, grant and agree to and with the said John Dorrance his - - - heirs and assigns, that he the said John L Butler his - - - heirs, all and singular the hereditaments and premises herein above described and granted, or mentioned, and intended so to be, with the appurtenances, unto the said John Dorrance his - - - heirs and assigns, against him the said John L Butler his - - - heirs, and against all and every other person or persons whomsoever lawfully claiming or to claim the same or any part thereof, - - - shall and will - - - Warrant and forever Defend. In witness whereof the said parties to these presents have hereunto interchangeably set their hands and seals. Dated the day and year first above written.

On the Seventeenth day of April Anno Domini one thousand eight hundred and forty one before me President Judge of the court of common pleas of Luzerne County, Pennsylvania personally appeared the above named John L. Butler and Cornelia R - - his wife and in due form of law acknowledged the above Indenture to be their act and deed and desired the same might be recorded as such and the said Cornelia R - - being of full age and separate and apart from her said husband by me thereon privately examined and the full contents of the above Deed being by me first made known unto her did thereupon declare and say that she did voluntarily and of her own free will and accord sign seal and as her act and deed deliver the above written Indenture Deed or Conveyance without any coercion or compulsion of her said husband Witness my hand and seal the day and year aforesaid John N Conyngham Pro[thnotary].
