Description:

The following item depicts two photostats by unknown at an unknown date, of an original deed transfer by Andrew Todd McClintock and Augusta Cist McClintock, his wife, to Sarah Blanchard, dated May 6, 1860. The deed is being sold for $1.00 to Blanchard.The lands in the sale were originally part of a sale between the county sheriff, Samuel Van Loon, to Andrew Todd McClintock, the details of which were logged in the Deed Books No 15. The acreage and location of the lands were likely detailed in this document. The deed is witnessed by Stephen Vaughn and recorded in the sheriff’s office by him as a justice of the peace on May 26, 1860. There is a stipulation concerning a position of land and coal rights that have been withheld from Sarah and John Blanchard for the use of the Bloomsburg Railroad & Iron Company. This contract was logged in the Records Office for Luzerne county in Book No 47. There is a stipulation concerning a position of land and coal rights that have been withheld from Sarah and John Blanchard for the use of the Pennsylvania Coal Company. This contract was dated between the company and Andrew Todd McClintock on May 24, 1860, and includes 23 acres and 133 perches of the tract in question. The deed transfer notes that Sarah Blanchard had also signed this contract on May 25, 1860. This is a printer copy and related to item 3e. ✓Andrew T. McClintock & wife } Know all men by these presents that To } we Andrew T. McClintock of Wilkes-Barre Sarah Blanchard } Luzerne County Pennsylvania and Augusta his wife for and in consideration of the sum of one Dollar to us in hand paid by Sarah Blanchard of Jenkins Township Luzerne County Pennsylvania, the receipt whereof is hereby acknowledged, been assigned transferred & set over and by these presents, do assign, transfer and set over unto the said Sarah Blanchard her heirs and assigns, all our right, title, interest, claim or demand of into or unto all that certain tract of land particularly described in the within Deed of Samuel Van Loon Sh[eri]ff to said Andrew T. McClintock, recorded in Sh[eri]ff Deed Book No 15. page 285– with the appurtenances reserving and excepting however out of the same all the land & coal rights and privileges conveyed by John Blanchard & wife to the Bloomsburg Railroad & Iron Company & recorded in Recorders office for Luzerne County in Deed Book No 47 page 480&c and therein particularly described. And also reserving and excepting out of the same all the Coal & other minerals rights & privileges in twenty three acres and 133 perches part of within described tract of land conveyed to the Pennsylvania Coal Company by Andrew T. McClintock & wife by their Deed dated the 24th day of May 1860 and by said Sarah Blanchard by her Deed dated the 25th day of May A.D. 1860, and intended to be forthwith recorded, and in said Deeds particularly described and set forth. To have and to hold the said within described tract of land with the appurtenances—Excepting & reserving as aforesaid unto the said Sarah Blanchard her heirs & assigned, to and for the only use & behoof of the said Sarah Blanchard her heirs & assigns forever. In witness whereof we have hereunto set our hands & seals this twenty sixth day of May A.D. one thousand eight hundred and Sixty. In the presence of } Ex Andrew T. Luzerne County S.S. [sheriff station]. Be it remembered that on the twenty sixth day of May A.D. 1860. Before me, the subscriber, a Justice of the Peace in & for said County, personably appeared the above named Andrew T. McClintock and August his wife and in due form of law sensably(sic) [sensibly] acknowledged the above written assignment to be their act and Deed & as such desired the sum to be recorded— She the said Augusta being of full age and by me examined privately thereon separate & apart from her said husband the contents of the said assignment being by me first fully made known to her did declare & say that she did voluntarily and of her own free will & accord sign, seal and as & for her act and Deed deliver the said assignment without any coercion on compulsion of her said husband.
