Description:

The following item depicts a detailing of the deed transfer of the late John Dorrance’s to Stpehen Leonard Thurlow, overseen and instructed by Charles Buckingham Dorrance, the executor of Dorrance’s estate, dated October 20, 1862. The land contains one half of an acre and two and three fourths square rods, or twenty two thousand, four hundred, and fifty square feet of Land, located on South Franklin street in Wilkes Barre, Pennsylvania, and is being sold to Thurlow for the sum of $8,500. The account has two names as witnesses and advisors in the last will of Dorrance, the first his executor, Charles, and Andrew Todd McClintock. They have read the will carefully and find that the sale is amenable by the testified will of Dorrance. There is a tax on the recording of the account and sale amounting to $2.75, approved by Wesley Kunkle, the recorder in the Luzerne county sheriff’s office.

This Indenture made the seventeenth day of October, Anno Domini, one thousand eight hundred and sixty two, Between Charles B. Dorrance Executor of the last will and testament of John Dorrance, late of the Borough of Wilkes Barre Luzerne County, Pennsylvania, deceased, of the one part, and Stephen Leonard Thurlow, of the said Borough of Wilkes Barre, of the other part, Witnesseth That the said Charles B. Dorrance Executor as aforesaid for and in consideration of the sum of Eight Thousand and Five Hundred Dollars lawful money of the United States of America unto him well and truly paid by the said Stephen Leonard Thurlow as or before the sealing and delivery of these presents the receipt whereof is hereby acknowledged, hath granted bargained sold aliened enfeoffed released conveyed and confirmed, and by these presents doth grant bargain sell alien enfeoff release convey and Confirm unto the said Stephen Leonard Thurlow his heirs and assigns All that the following piece or parcel of Land on Franklin Street in the Borough of Wilkes Barre aforesaid bounded and described as follows, viz, Beginning at a corner on Franklin street fifty feet distant from the line between lots Nos. 2 and 3 in the townspolot [townsplot] of the Borough of Wilkes Barre thence North fifty five degrees twenty minutes east along said street one hundred feet to a corner; thence north thirty four degrees forty minutes west two hundred twenty four feet and five tenths to a corner, thence south fifty five degrees twenty minutes west one hundred feet to a corner; and thence south thirty four degrees

forty minutes east two hundred twenty four feet and five tenths to the place of Beginning Containing One Half of an acre and two and three fourths square rods, or Twenty two thousand four hundred and fifty square feet of Land, being the same lot of Land conveyed to the aforesaid John Dorrance by John L. Butler and Cornelia his Wife by their Deed dated the 17th day of April A.D. 1841, and Recorded in the office for Recording Deeds to in and on the aforesaid County of Luzerne in Deed Book No. 37 page 417 +c- And the said John Dorrance by his last will and testament dated the 16th day of April A.D. 1861 and duly proved the 21st day of May A.D. 1861 and Registered in the Register’s Office in and on said County of Luzerne empowered and authorized his aforesaid Executor to sell any and all his real Estate- such sales however to be made under the advice and written consent of Charles Dorrance and Andrew T. McClintock or of the survivor of them which advice and written consent of the said Charles Dorrance and Andrew T. McClintock for the sale of the herein above described Lot of Land part of the Estate of the said John Dorrance deceased to the said Stephen Leonard Thurlow at private sale for the consideration hereinabove mentioned are given to the said Executor as appears by the advice and written consent of the said Charles Dorrance and Andrew T. McClintock annexed hereto and of even date herewith, in pursuance thereof the said sale and this conveyance for the Carrying out of the same are made- Together with all and singular the

improvements ways waters water courses right liberties privileges hereditaments and appurtenances, whatsoever thereunto belonging or in anywise appertaining and the revisions and remainders rents issues and profits thereof, and all the estate right title wheres property claim and demand whatsoever of the said John Dorrance in his life- time and at and immediately before the time of his decease and of the said Charles B. Dorrance, of in to or out of the same and every part and parcel thereof— To Have and To Hold the said piece or parcel of Land hereditaments and premises hereby granted or mentioned and intended so to be with the appurtenances unto the said Stephen Leonard Thurlow his heirs and assigns, to and for the only proper use and Behoof of the said Stephen Leonard Thurlow his heirs and assigns forever- And the said Charles B. Dorrance, Executor as aforesaid, for himself his heirs executors and administration and for the Estate of the said decedent doth by these presents covenant grant and agree to and with the said Stephen Leonard Thurlow his heirs and assigns that he the said Charles B. Dorrance and his heirs all and singular the hereditaments and premises herein above described and granted or mentioned or intended so to be with the appurtenances unto the said Stephen Leonard Thurlow his heirs and assigns against him the said Charles B. Dorrance and his heirs and--- against all and every other person or persons whomsoever lawfully claiming or to claim the same or any part thereof shall and will Warrant

[Anno Domini] one thousand eight hundred and sixty two, Before me, the subscriber, a Justice of the Peace in and for said County, personally appeared the above named Charles B. Dorrance Executor of the last will and testament of John Dorrance deceased and in due form of Law acknowledge the above written Indenture to be his act and Deed and as such descried (sic) [described] the same to be recorded- In Witness whereof I have hereunto set my hand and seal the day and year last above written- S.D. Lewis Justice of the Peace

To Charles B. Dorrance Executor of the last will and testament of John Dorrance late of Wilkes Barre Borough, Luzerne County Pennsylvania Dec[ease]d- Under the last will and testament of the said John Dorrance deceased, of which you are the Executor duly appointed, you have hower and authority given and granted to you as such Executor to sell any and all the seal Estate of the said Testator under the advice and written consent of the subscribers as appears by said will duly proved and Registered in the Register’s Office in and on said County of Luzerne. Now we, Charles Dorrance of Kingston Township in said County and And[re]w. T. McClintock of the said Borough, the person named in said Will as your advisers, do hereby advise and hereby in writing consent to the sale by you, the said Executor of said Will in pursuance of the power and authority given and granted to you therein, of the House and Lot situate on Franklin Street in the said Borough of Wilkes-Barre, which Lot in particularly described in the deed of John S. Butler + Wife to said John Dorrance, dubed (sic) [dubbed] the 16th day of April A.D. 1841, and Recorded in the Recorder’s office for said County of Luzerne in Deed Book No. 37 page 417 &c- [etcetera] and is part of the Real Estate of the said Testator, to Stephen Leonard Thurlow as private sale for the consideration of Eight Thousand Five Hundred Dollars- Twenty Five Hundred dollars thereof to be paid in Cash and the balance thereof to be secured by Boudaud Mortgage on the premises, payable in yearly instalments of one thousand dollars each- with interest from the 14th day of April neks as which time
