Deed from Stephen Leornard Thurlow to Andrew T. McClintock

Description:

The following item depicts a deed transfer and sale between Stephen Leonard Thurlow and Lydia Mary Thurlow, his wife, to Andrew Todd McClintock, dated August 20, 1864. In the deed, McClintock is purchasing a plot of land on South Franklin street in Wilkes Barre, containing one half of an acre and two and three fourths square rods, or twenty two thousand, four hundred, and fifty square feet of Land acres for the sum of $1.00 paid in full. There is a note at the bottom of the page bestowing Lydia Mary the rights of signer of the document of sale in the case of Thurlow’s death. On August 23, 1864, Thurlow and Lydia Mary appeared to have the document and instrument signed before the sheriff’s recorder’s office in Luzerne county. This document is testified to by S. D. Lewis, possibly Sharp Delany Lewis on the same date. There is a tax on the record and sale of the contract, amounting to $2.25, signed by George Kirkendall and Schooley.

This Indenture, MADE the Twentieth day of August in the year of our Lord one thousand eight hundred and Sixty = Four BETWEEN Stephen Leonard Thurlow, of the Borough of Wilkes=Barre, County of Luzerne and State of Pennsylvania, and Lydia Mary his Wife of the one part, and Andrew T. McClintock of the same place, In Trust as hereinafter provided, —------------------------------------------------------------







of the other part, Witnesseth, that the said Stephen Leonard Thurlow and Lydia Mary his Wife —------------------------------------------------------------------------------------------- for and in consideration of the sum of One Dollar —---------------------------------------------- lawful money of the United States of America, unto them well and truly paid by the said Andrew T. McClintock —---------------------------------------------------------------------------------------------- at and before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged, have granted, bargained, sold, aliened, enfeoffed, released and confirmed, and by these presents do grant, bargain, sell, alien, enfeoff, release and confirm unto the said Andrew T. McClintock and his Heirs and Assigns, In Trust as hereinafter provided, All that certain Lot, Piece or Parcel of Land, situate in the Borough of Wilkes=Barre, aforesaid, on Franklin Street, and bounded and described as follows, to wit; Beginning, at a corner on said Franklin Street, fifty feet distant from the line between lots Numbers Two and Three in the Town plot of the Borough of Wilkes Barre, thence North fifty five degrees, twenty minutes East along said street one hundred feet to a corner; thence North thirty four degrees, forty minutes West two hundred and twenty four and five tenths feet to a corner, thence South fifty five degrees twenty minutes West one hundred feet to a corner, and thence South thirty four degrees forty minutes East two hundred and twenty four and five tenths feet to the place of Beginning. In Trust nevertheless for the said Lydia Mary Thurlow, Wife of the said Stephen Leonard Thurlow, for and during her natural life, and after her death for the children of the said Stephen Leonard Thurlow, on the body of the said Lydia Mary, begotten and their Heirs and Assigns forever, with power however to the said Andrew T. McClintock and his heirs to sell and convey the aforesaid Lot, Piece or Parcel of Land or any time, at such price and on such terms, as the said Andrew T. McClintock or his heirs may deem sufficient, with the written consent of the said Stephen Leonard Thurlow and Lydia Mary Thurlow his wife, or in case of the death of the said Stephen Leonard Thurlow before the death of his said Wife, with the written consent of the said Lydia Mary Thurlow, the purchase money upon any such sale, to be paid over by the said Trustee or his Heirs, to the said Lydia Mary Thurlow, to be by her invested, as she may prefer, without any liability or responsibility, on part of said Trustee.-----------------------------------------------------------------------------------------------------------------

and in due form of law acknowledged the within or forgoing Indenture to be their act and deed, and desired the same might be recorded as such. And the said Lydia Mary, being of full age and separate and apart from her said husband by me thereon privately examined and the full contents of the above deed being by me first made known unto her, did thereupon declare and say that she did voluntarily and of her own free will and accord, sign, seal and as her act and deed deliver, the above written indenture, deed or conveyance without any coercion or compulsion of her said husband.
