Description:
The following item depicts a deed sale being rendered by Andrew Todd McClintock, of a joint sale of property held between himself, and Stephen Leonard and Lydia Mary Thurlow, to Jasper Billings Stark, dated June 1, 1872. The property contains a plot of land on South Franklin street in Wilkes Barre, containing one half of an acre and two and three fourths square rods, or twenty two thousand, four hundred, and fifty square feet of Land acres for the sum of $36,000. McClintock is the trustee on the contract with the Thurlows, and the contract is witnessed by Winfield Scott Parsons and G. R. Bedford. The contract was brought before the sheriff’s office to be recorded on June 4, 1872, and testified to by Parsons. There was a tax on the recording and filing of the instrument, dated June 6, 1872, amounting to a sum of $2.75.

This Indenture, MADE the first day of June in the year of our Lord one thousand eight hundred and seventy two BETWEEN Andrew T. McClintock Trustee +c [etcetera]. and Stephen Leonard Thurlow and Lydia M. his Wife, all of the City of Wilkes-Barre, County of Luzerne, and State of Pennsylvania parties of the first part, And Jasper A. Stark of the same place, of the other part.
Whereas the said S.L. Thurlow and Lydia M. his Wife by Indenture dated August 20th 1864 and duly recorded in the office for recording deeds +c. in Deed Book No. 98 page 322, &c [etcetera]. did come unto said Andrew T. McClintock his heirs and assign a certain lot of land situate on Franklin Street in the then Borough of Wilkes Barre, and hereinafter particularly described ; In trust nevertheless to hold the same for the said Lydia M. Thurlow during her life, with remainder to the children of the said S.L. Thurlow on the body of the said Lydia M. begotten, their heirs and assigned forever, with power however to said Trustee to sell and convey the aforesaid lot at any time at such price and on such terms as he may deem sufficient, with the written consent of said S.L. Thurlow and Lydia M. his Wife, if both be living.----------------------------------------------------------
And Whereas the said Andrew T. McClintock trustee, hath made sale of and agreed to convey said lot of land to said Jasper B. Stark at and for the price of thirty six thousand dollars.------------
And whereas the said S.L. Thurlow and Lydia M. his Wife have consented to said sale to said Jasper B. Stark and by joining in this conveyance do in writing consent thereto.-----------------------

Now this Indenture witnesseth, That the said Andrew T. McClintock Trustee +c.[etcetera] --------------------for and in consideration of the sum of thirty six thousand dollars------------------------- lawful money of the United States, to him in hand paid by the said Jasper B. Stark at and before the sealing and delivery hereof, the receipt whereof is hereby acknowledged, hath granted, bargained, sold, aligned, released and confirmed, and by these presents, with the written consent a aforesaid of said S.L. Thurlow and Lydia M. his Wife, doth---------------------------------------------------------------------------------------------------- grant, bargain, sell, alien, release and confirm unto the said Jasper B. Stark his heirs and assign all that certain message, tenement, and lot of land situate on the North Westerly side of Franklin Street in the City of Wilkes Barre aforesaid, described as follows to with. Beginning at a corner on said Street fifty feet distant from the line between lots No. Two and Three on the Town plot of the Borough of Wilkes Barre. thence along said Street North fifty five degrees and twenty minutes East one hundred feet to a corner, thence North thirty four degrees and forty minutes West two hundred twenty four and one half feet to a corner, thence South fifty five degree and twenty minutes West one hundred feet to a corner, thence South thirty four degrees and forty minutes East two hundred and twenty four and one half feet to the place of beginning. Containing one half acre and two and three fourths square nods of land.

TOGETHER with all and singular the buildings---- ways, waters, water-courses, rights, liberties, privileges, hereditaments and Appurtenances whatsoever thereunto belonging, or in any wise appertaining, and the Reversions and Remainders, Rents, Issues and Profits thereof ; and also all the estate, right, title, interest, use, trust, property, possession, claim and demand whatsoever, of him the said Andrew T. McClintock, Trustee, or of their the said S. L. Thurlow and Lydia M. his Wife,-------------------- in law, equity, or otherwise howsoever, of, in, to or out of the same:
To have and to hold the said message, tenement and lot of land.----- Hereditaments and Premises hereby granted and released, or mentioned and intended so to be, with the appurtenances, unto the said Jasper B. Stark his heirs------ and Assigns, to and for the only proper use and behoof of the said Jasper B. Stark his heirs-------- or Assigns for ever.
AND the said Andrew J. McClintock for himself, his heirs, executors and administrator doth----------------------------------------------- covenant, promise and agree, to and with the said Jasper B. Stark his heirs------- and Assigns, by these presents, that he the said [Andrew T. McClintock] hath not done, committed, or knowingly or willingly suffered to be done or committed, any act, matter or thing whatsoever, whereby the Premises hereby granted, or any part thereof, is, are, shall or may be impeached, charged or encumbered, in title, charge, estate, or otherwise howsoever. McClintock and S. L. Thurlow and Lydia M. Thurlow his Wife who in due form of laws acknowledged the above written Indenture to be their act and deed for the purposes therein mentioned, and as such desired the same might be recorded. And the said Lydia M. Thurlow being of full age and by me privately examined separate and apart from her said husband, the full contents hereof being by me first made known to her, did declare and say that she did voluntarily and of her own free will and accord sign, seal and an her act and deed deliver said Indenture, and by joining therein did voluntarily in writing consent to the sale thereby ade without any coercion or compulsion on the part of her said husband.
