Deed sale from Jasper B. Stark to Jesse Thomas

Description:

The following item depicts a deed transfer sale written by Winfield Scott Parsons, for a sale of Jasper Billings and Frances R. Spark to Jesse Thomas, dated January 14, 1875. The property contains a plot of land on South Franklin street in Wilkes Barre, containing one half of an acre and two and three fourths square rods, or twenty two thousand, four hundred, and fifty square feet of Land acres for the sum of $44, 000. McClintock is the trustee on the contract with the Thurlows, and the contract is witnessed by Winfield Scott Parsons.The contract was brought before the sheriff’s office to be recorded on January 23, 1875, by Ano K Paisir, and was testified to by Parsons on the day of the sale originally on the 14th. There was a tax on the recording and filing of the instrument, dated January 23, 1875, amounting to a sum of $2.25. The deed states that the land is still held by Jesse Thomas on December 26, 1900.

This Indenture, MADE THE fourteenth day of January, in the year of our Lord one thousand eight hundred and Seventy five Between Jasper B. Stark and Francis R his wife of the City of Wilkes Barre County of Luzerne and state of Pennsylvania of the first part, and Jesse Thomas City. County. and state aforesaid of the second part: WITNESSETH, That the said party of the first part, for and in consideration of the sum of Forty Four Thousand Dollars Dollars, lawful money of the United States of America, unto them well and truly paid by the said party of the second part, at and before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged, have granted, bargained, sold, aligned, released. conveyed and confirmed, and by these presents, do grant, bargain, sell, alien, release, convey and confirm, unto the said party of the second part, his heirs and assigns, All that certain Message tenements and lot of land situate on the North Westerly side of Franklin Street in the City of Wilkes Barre aforesaid described as follows to wit: Beginning at a corner on said Street fifty feet distant from the line between lots Nos Two and Three on the same plot of the ^City late Borough of Wilkes Barre. thence along said street North fifty five degrees and twenty minutes East one hundred feet to a corner. thence North thirty four degrees and forty minutes West two hundred twenty four and one half feet to a corner, thence South fifty five degrees and twenty minutes West one hundred feet to a corner. thence South thirty four degrees and forty minutes East two hundred and twenty four and one half feet to the place of beginning Containing one half acre and two and three fourths square rods of land- And Being the same premises which Andrew T.

McClintock Trustee by deed bearing date the First day of June AD 1872 and duly recorded in the proper office for the recording of deeds +c [etcetera] in and for the said County of Luzerne in Deed Book No. 158 page 540 conveyed to the said Jasper B. Stark in fee.

Together with all and singular, the tenements, hereditaments and appurtenances, to the same belonging, or in any wise appertaining, and the reversion and reversions, remainder and remainders, rents, issues and profits thereof ; AND ALSO, all the estate, right, tile, interest, property, claim and demand whatsoever, both in law and equity, of the said party of the first part, of, in, to, or out of the said premises, and every part and parcel thereof. To have and to hold the said premises, with all and singular the appurtenances, unto the said party of the second part, his heirs and assigns, to and for the only proper use and behoof of the said party of the second part, his heirs and assigns forever. AND the said Jasper B Stark and Francis R his wife their heirs, executors and administrators, do by these presents covenant, grant and agree to and with the said party of the second part, his heirs and assigns, that the the said Jasper B Stark and Francis R his wife their heirs, all and singular the hereditaments and premises herein above described and granted, or mentioned and intended so to be with the appurtenances, unto the said party of the second part, his heirs and assigns, against the said party of the first part, and their heirs, and against all and every other person or persons whomsoever, lawfully claiming or to claim the same or any part thereof, shall and will by these presents, WARRANT AND FOREVER DEFEND. IN WITNESS WHEREOF, the said part of the first part have hereunto set their hands and seals, the day and year first above written.

On the Fourteenth day of January Anno Domini 1875, before me An Alderman of the City of Wilkes Barre and at office a Justice of the Peace for said County personally appeared, the above named Jasper B Stark and Francis R his wife and in due form of law acknowledged the above Indenture to be their and each of their act and deed, and desired the same might be recorded as such; and the said Francis R Stark being of full age, and separate and apart from her said husband by me thereon privately examined and the full contents of the above Deed being by me first made known unto her did thereupon declare and say that she did voluntarily and of her own free will and accord, sign, seal, and as her act and deed, deliver, the above written Indenture, Deed or Conveyance, without any coercion or compulsion of her said husband .
